Terms of Service
This website is operated by K10 Medical Supply LLC dba OrthoTape.com. Throughout this website, the terms "OrthoTape," "we," "us," and "our" refer to K10 Medical Supply LLC dba OrthoTape.com.
OrthoTape provides this website, including the information, products, tools, features, and services available through it, conditioned upon your acceptance of these Terms of Service and the policies and notices incorporated into them.
Please read these Terms of Service carefully before using our website or placing an order. By accessing or using this website, creating an account, submitting an order, purchasing a product, or otherwise using our services, you agree to these Terms of Service and the applicable policies incorporated into them.
SECTION 1 - AGREEMENT TO TERMS, INCORPORATED POLICIES, AND CHECKOUT ACCEPTANCE
These Terms of Service govern your use of OrthoTape.com and purchases made through our website.
The following policies are expressly incorporated into and form part of these Terms of Service:
Product-specific restrictions, sizing requirements, return conditions, cancellation restrictions, restocking fees, shipping information, and other material terms that are clearly disclosed on a product page, in the shopping cart, or during checkout also form part of the terms applicable to that transaction.
Checkout Terms and Conditions Acceptance
When checkout presents a required checkbox or similar control stating that you agree to OrthoTape's Terms of Service, Shipping Policy, Returns and Refunds Policy, or other identified policies, checking that box constitutes your affirmative electronic acceptance of those policies.
Where such an acceptance control is presented, you may be required to accept the applicable terms before you can continue with checkout or complete your purchase.
Submitting an order also constitutes your agreement to the terms, policies, product information, pricing, shipping charges, and other material transaction information made available to you before the order is completed, to the extent permitted by applicable law.
Which Terms Apply to a Purchase
A completed transaction is governed by the terms, policies, and transaction-specific disclosures that were made available and applicable to that purchase when the order was placed. Later changes to our policies do not retroactively change the material terms of a previously completed transaction unless required by applicable law or separately agreed to by the parties.
If provisions applicable to a particular transaction differ, the more specific transaction or product disclosure presented before purchase will control for that particular issue. For matters relating specifically to returns and refunds, the Returns and Refunds Policy controls. For matters relating specifically to shipment, fulfillment, and delivery, the Shipping Policy controls. These Terms of Service govern all other matters unless applicable law requires otherwise.
SECTION 2 - ELECTRONIC COMMUNICATIONS, CONSENT RECORDS, AND TRANSACTION RECORDS
By using OrthoTape.com or placing an order electronically, you consent to transact with us electronically to the extent permitted by applicable law.
Electronic actions may include placing an order, checking a terms-and-conditions acceptance box, submitting a return request, communicating through email or online forms, and accepting transaction-specific disclosures.
Where available, OrthoTape and its service providers may maintain records relating to a transaction or agreement, including:
- Order date and time
- Checkout and policy-acceptance records
- Terms-and-conditions acceptance timestamps where available
- Order and payment records
- Billing and shipping information
- Fraud-analysis and transaction-verification information
- IP address and related transaction information where collected
- Product and pricing information
- Shipping and delivery records
- Return Authorization records
- Return tracking and inspection records
- Refund transaction records
- Email, chat, form, and customer-service communications
These records may be used for order administration, customer service, fraud prevention, returns, refunds, warranty claims, payment disputes, regulatory compliance, and other legitimate business purposes in accordance with our Privacy Policy and applicable law.
Electronic records and communications may satisfy requirements that information or agreements be provided in writing to the extent permitted by applicable law.
SECTION 3 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or other jurisdiction of residence, or that you are the age of majority and have given permission for any minor dependents for whom you are legally responsible to use this website under your supervision.
You may not use our products, website, or services for any illegal or unauthorized purpose, and you may not violate any applicable law while using the website or services.
You must not transmit viruses, worms, malicious code, or other technology intended to interfere with or damage the website, our systems, or the systems of others.
A material breach of these Terms may result in suspension or termination of access to our services, subject to applicable law.
SECTION 4 - GENERAL CONDITIONS
We reserve the right to refuse or limit service, cancel orders, restrict accounts, or decline transactions where reasonably necessary for lawful business reasons, including suspected fraud, product restrictions, inventory limitations, regulatory requirements, payment issues, abusive conduct, or violations of these Terms.
Nothing in these Terms permits discrimination or other conduct prohibited by applicable law.
You understand that content you submit to the website, other than payment-card information, may be transferred over various networks and may be modified as technically necessary to conform to network or device requirements.
Payment-card information is handled through secure payment systems and service providers according to their applicable security standards.
You may not reproduce, duplicate, copy, sell, resell, or exploit a material portion of our website or services without our express written permission, except as permitted by applicable law.
Section headings are included for convenience and do not limit the meaning of these Terms.
SECTION 5 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We make reasonable efforts to provide accurate product, pricing, educational, sizing, shipping, and other information. However, information may occasionally contain errors, omissions, outdated information, or manufacturer-supplied information that later changes.
General educational information on this website should not be used as a substitute for professional medical evaluation, diagnosis, or treatment when professional medical care is appropriate.
Historical information may be provided for reference and may not reflect current products, pricing, policies, or recommendations.
We reserve the right to correct or update website information as appropriate.
SECTION 6 - MODIFICATIONS TO SERVICES, PRODUCTS, AND PRICES
Product prices, availability, specifications, promotions, and website features may change without advance notice.
We may modify or discontinue a product, service, website feature, promotion, or other offering at any time, subject to obligations that already apply to completed transactions and applicable law.
A price change made after a completed purchase does not change the price of that completed transaction unless an obvious pricing error or other circumstance allows correction under applicable law and these Terms.
SECTION 7 - PRODUCTS, MEDICAL DEVICES, SIZING, AND PRODUCT INFORMATION
Certain products may be available exclusively online and may have limited inventory.
Products are subject to return only according to our Returns and Refunds Policy and any applicable product-specific terms disclosed before purchase.
We make reasonable efforts to display product colors, images, configurations, and specifications accurately. Actual appearance can vary based on device displays, manufacturing changes, and other factors.
Product descriptions and specifications may be supplied in whole or in part by manufacturers. Manufacturers may update packaging, labeling, materials, designs, or specifications without advance notice.
Sizing and Product Selection
Customers are responsible for reviewing applicable product sizing charts, measurements, left/right configuration, product specifications, and other selection information before placing an order.
If a healthcare professional has prescribed or recommended a particular product, size, configuration, treatment, or method of use, the customer is responsible for ensuring that the product ordered is consistent with those instructions.
Fit can vary based on anatomy, measurement technique, swelling, body shape, product design, and other individual factors. A sizing recommendation or chart cannot guarantee a particular fit for every person.
Medical Information
Information provided on OrthoTape.com is intended primarily for product education and general informational purposes. It does not replace individualized medical diagnosis, treatment, imaging, physical examination, or professional medical advice when those services are appropriate.
Some orthopedic products may be intended for use under the direction or recommendation of a qualified healthcare professional. Customers should follow applicable product instructions and treatment recommendations.
Nothing in these Terms limits rights or remedies relating to defective products, product safety, or other protections that cannot lawfully be waived.
SECTION 8 - ORDERS, BILLING INFORMATION, PAYMENT, AND FRAUD REVIEW
You agree to provide current, complete, and accurate information for purchases made through our store, including billing, shipping, email, telephone, and payment information.
We reserve the right to refuse, hold, review, limit, or cancel an order where reasonably necessary.
Examples may include:
- Suspected fraud or unauthorized payment activity
- Address or identity-verification concerns
- Payment authorization problems
- Unusual ordering activity
- Product quantity limitations
- Inventory discrepancies
- Regulatory or shipping restrictions
- Orders appearing to be placed for unauthorized resale
Our payment processor, Shopify, payment networks, fraud-prevention providers, and other authorized service providers may evaluate transaction information for fraud and payment risk.
A fraud-risk indicator or automated recommendation is one factor that may be considered when deciding whether additional review is appropriate. We may request additional information or verification before fulfilling an order when reasonably necessary.
If we cancel an order that has already been charged and no merchandise has been shipped, the applicable payment will be refunded according to the payment method, applicable law, and payment-processing requirements.
We may limit quantities purchased per person, household, customer account, payment method, billing address, shipping address, or order when reasonably necessary.
SECTION 9 - RETURNS, REFUNDS, RESTOCKING FEES, AND EXCHANGES
Our complete Returns and Refunds Policy is expressly incorporated into these Terms and governs all returns and refunds.
Please review that policy before completing your purchase.
Key Return Terms
Subject to product eligibility and the complete Returns and Refunds Policy:
- Eligible products may generally be returned within 60 days from the date of delivery.
- Voluntary returns must generally be unused, unworn, complete, and in the required original packaging and resalable condition.
- Used or worn merchandise is not eligible for a refund under our voluntary return policy.
- The customer is responsible for return shipping on voluntary customer returns unless OrthoTape specifically agrees otherwise.
-
Original outbound shipping charges paid at checkout are non-refundable on voluntary customer returns, including returns involving size, fit, preference, ordering the wrong product, or no longer needing the product.
- Approved refunds are issued to the original payment method whenever possible.
- Returns are inspected before a refund is approved.
- Return processing may take up to the period stated in our Returns and Refunds Policy after the returned merchandise is received by OrthoTape.
Brand-Specific Restocking Fees
Eligible voluntary returns of the following brands are subject to a 20% restocking fee:
- EXOS
- DeSoutter
- DeRoyal
- DJO
- Enovis
- Aircast
For an approved voluntary return of one of these products, the customer therefore receives 80% of the eligible merchandise price before considering any separately non-refundable original outbound shipping charge.
Free-Shipping Orders
Eligible voluntary returns of merchandise originally shipped with free or promotional outbound shipping may be subject to a 20% restocking fee as described in the Returns and Refunds Policy.
If the same product already carries a 20% brand-specific restocking fee, a second 20% fee is not added merely because the order also received free shipping.
Packaging and Condition Fees
An otherwise eligible unused product returned without required original packaging, or returned with packaging or condition damage that materially reduces its ability to be resold as new, may be subject to a 50% restocking fee as described in the Returns and Refunds Policy.
Percentage-based restocking fees do not stack. If more than one percentage-based restocking category applies to the same returned item, the highest applicable restocking percentage is used rather than adding multiple percentages together.
Non-refundable original outbound shipping and customer-paid return shipping are separate from percentage-based restocking fees.
Exchanges
OrthoTape does not process direct exchanges.
If you require a different size, side, color, model, or product, you may place a new order for the replacement product and separately return the original eligible item.
The replacement order is a separate transaction and is subject to the prices and shipping charges applicable when that order is placed.
A returned item does not automatically qualify for a full refund. The amount refunded is determined under the Returns and Refunds Policy.

SECTION 10 - SHIPPING, FULFILLMENT, AND DELIVERY
Our complete Shipping Policy is expressly incorporated into these Terms and governs order processing, fulfillment, shipment, delivery, carrier issues, and related matters.
Please review the Shipping Policy before completing your purchase.
Processing Time and Transit Time
Order-processing or fulfillment time and carrier transit time are separate.
A shipping method such as UPS Next Day Air, UPS 2nd Day Air, or another expedited service generally describes the carrier service after the carrier receives the package. It does not necessarily mean that an order will leave a warehouse on the same day it is placed unless expressly stated.
Warehouse processing, inventory availability, order time, weekends, holidays, product-specific handling requirements, manufacturer fulfillment, fraud review, and other factors may affect the shipment date.
Estimated shipment and delivery dates are estimates unless expressly identified as guaranteed.
Delivery Information
Customers are responsible for providing a complete and accurate delivery address.
Carriers may use tracking scans, delivery photographs, GPS information, signatures, electronic records, or other data when documenting delivery.
If tracking indicates delivery but a package cannot be located, the customer should promptly check the delivery area, household members, neighbors, mailrooms, front desks, building management, and other reasonable locations where the carrier may have left the shipment.
OrthoTape may request customer cooperation with a carrier investigation or claim.
Each missing-delivery claim will be evaluated based on the available evidence, carrier information, the circumstances of the shipment, our Shipping Policy, and applicable law.
International Orders
Where international shipping is available, customers may be responsible for customs duties, import taxes, brokerage fees, regulatory requirements, or other charges imposed by the destination country unless those charges are expressly included at checkout.
SECTION 11 - WARRANTY, MANUFACTURING DEFECTS, AND NORMAL WEAR
Unless a product page or manufacturer provides a different written warranty, K10 Medical Supply LLC dba OrthoTape provides a 4-month limited warranty against manufacturing defects beginning on the delivery date, subject to the complete terms in our Returns and Refunds Policy.
The normal remedy for an approved warranty claim is replacement of the same product or, when appropriate, a reasonably comparable replacement. If replacement is unavailable or is not a reasonable remedy under the circumstances, another remedy such as store credit or refund may be provided as appropriate.
Normal wear and tear is not a manufacturing defect.
Examples of normal wear may include:
- Fabric pilling or minor fraying at high-friction areas
- Gradual elastic relaxation
- Lint accumulation in hook-and-loop fasteners
- Gradual reduction in hook-and-loop adhesion from repeated use or contamination
- Discoloration from skin contact, perspiration, laundering, or environmental exposure
Warranty coverage does not apply to damage reasonably attributable to misuse, abuse, accidental damage, improper sizing or application, unauthorized alteration, pet damage, improper cleaning, ordinary deterioration from use, or other causes unrelated to a manufacturing defect.
We may request photographs, video, descriptions, product-use information, or return of the product when reasonably necessary to evaluate a warranty claim.
Nothing in this section eliminates rights or remedies that cannot lawfully be excluded.
SECTION 12 - OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to third-party tools or services that we do not own or directly control.
Third-party tools may be provided "as is" and "as available" and may be governed by their own terms and privacy practices.
Your use of optional third-party tools is at your discretion, and you should review the applicable third-party terms before using them.
New website tools, features, and services may also be subject to these Terms.
SECTION 13 - THIRD-PARTY LINKS
Our website may contain links to third-party websites, manufacturers, carriers, payment providers, educational resources, or other external services.
We do not control third-party websites and are not responsible for their independent content, policies, availability, security, or practices.
Please review the policies and terms of any third-party site before completing a transaction or providing personal information to that third party.
SECTION 14 - USER COMMENTS, FEEDBACK, REVIEWS, AND OTHER SUBMISSIONS
If you submit feedback, reviews, suggestions, photographs, comments, or other content to us, you represent that you have the right to provide that material and that your submission does not violate applicable law or the rights of another person.
You may not submit material that is knowingly false, unlawful, defamatory, threatening, malicious, infringing, deceptive, or designed to introduce malicious software.
We may moderate, remove, decline to publish, or retain user-submitted content as permitted by applicable law and our policies.
We take no responsibility for the accuracy of content independently submitted by third parties.
SECTION 15 - PERSONAL INFORMATION
Your submission and our handling of personal information are governed by our Privacy Policy.
Payment, fraud-prevention, shipping, communications, analytics, and other authorized service providers may process information as necessary to provide their services and as described in the Privacy Policy.
SECTION 16 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies, omissions, outdated information, or technical errors relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times, availability, or other information.
We reserve the right to correct errors or inaccuracies and to update information as appropriate.
If a material error affects an order, we may contact the customer and take reasonable corrective action, including cancellation and refund where appropriate and permitted by applicable law.
SECTION 17 - PROHIBITED USES
You may not use this website or its content:
- For an unlawful purpose
- To encourage or participate in unlawful acts
- To violate applicable laws or regulations
- To infringe intellectual-property or proprietary rights
- To harass, threaten, abuse, defame, discriminate against, or unlawfully harm another person
- To knowingly submit false or misleading information
- To upload or transmit malicious code
- To improperly collect or track personal information belonging to others
- To spam, phish, scrape, crawl, or interfere with the website contrary to applicable law
- To circumvent website or payment security features
- To engage in fraudulent transaction, return, warranty, or account activity
We may suspend or terminate access to the website for material violations of these requirements, subject to applicable law.
SECTION 18 - DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, we do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.
Except for warranties expressly provided by OrthoTape, a manufacturer, or applicable law, the website and services are provided on an "as is" and "as available" basis.
Nothing in these Terms excludes, limits, or disclaims any warranty, right, remedy, or protection that applicable law does not permit us to exclude or limit.
SECTION 19 - LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, K10 Medical Supply LLC dba OrthoTape.com and its officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website or services where such damages may lawfully be excluded.
This limitation does not apply to liability that cannot legally be limited or excluded, including any liability for which applicable law requires a different remedy or standard.
Nothing in these Terms is intended to eliminate legally protected claims relating to product safety, consumer protection, fraud, gross negligence, willful misconduct, or other rights that cannot lawfully be waived.
SECTION 20 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless K10 Medical Supply LLC dba OrthoTape.com and its affiliates, officers, employees, agents, contractors, licensors, service providers, and suppliers from third-party claims arising directly from your unlawful use of the website, your material breach of these Terms, or your violation of the legal rights of another person.
This provision does not require a consumer to indemnify OrthoTape for OrthoTape's own unlawful conduct, negligence where indemnification is prohibited, or liability that cannot lawfully be shifted to the consumer.
SECTION 21 - SEVERABILITY
If any provision of these Terms is determined by a court or other authority with proper jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue in effect unless applicable law requires otherwise.
SECTION 22 - TERMINATION
The obligations and liabilities incurred before termination of these Terms will survive where appropriate.
You may stop using our website at any time.
We may suspend or terminate access to the website or services if we reasonably determine that a user has materially violated these Terms, engaged in unlawful or fraudulent activity, threatened the security of the website or others, or otherwise created a legitimate legal or operational reason for termination.
Termination does not eliminate obligations relating to completed transactions, payments, returns, refunds, warranties, disputes, intellectual property, privacy, or other provisions that by their nature survive termination.
SECTION 23 - PAYMENT DISPUTES AND CHARGEBACKS
If you have a question about a charge, return, refund, delivery, or transaction, we encourage you to contact OrthoTape promptly so that we can investigate and attempt to resolve the issue.
Email: help@orthotape.com
Phone: 800-580-9887
Customers retain all dispute, billing-error, chargeback, and other rights provided by applicable law and their card issuer or payment provider.
If a payment dispute or chargeback is opened, OrthoTape may provide relevant documentation to our payment processor, acquiring bank, payment network, issuing bank, or other authorized dispute-resolution participant.
Such documentation may include:
- Order and payment records
- Checkout and policy-acceptance records where available
- Terms-and-conditions acceptance timestamps where available
- Applicable policies and transaction-specific terms
- Product descriptions and pricing information
- Billing and shipping verification information
- Fraud-analysis indicators
- IP and transaction information where lawfully collected
- Shipping and delivery confirmation
- Return Authorization information
- Return tracking and inspection records
- Refund transaction records and payment-network reference information where available
- Emails, forms, chats, and other customer communications
OrthoTape may contest a payment dispute when our records show that the transaction, delivery, return, refund, customer authorization, or applicable terms do not support the claim made in the dispute.
If a payment dispute has already been opened while a separate refund is pending or being processed, we may coordinate with our payment processor before taking additional payment action in order to avoid an unintended duplicate credit or duplicate reimbursement. Nothing in this provision permits us to withhold a refund that applicable law requires us to provide.
Nothing in this section limits or waives any consumer right that cannot lawfully be waived.
SECTION 24 - GOVERNING LAW
These Terms of Service and transactions with K10 Medical Supply LLC dba OrthoTape.com are governed by applicable federal law and, where permitted, the laws of the State of South Carolina, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of mandatory protections provided by the law of the consumer's jurisdiction when those protections legally apply and cannot be waived by agreement.
SECTION 25 - ENTIRE AGREEMENT AND ORDER OF PRECEDENCE
These Terms of Service, together with the policies incorporated by reference and applicable transaction-specific disclosures, constitute the agreement governing your use of OrthoTape.com and purchases made through the website.
The following policies are specifically incorporated into these Terms:
For purposes of interpreting a transaction:
- A specific material term clearly disclosed for the particular product or transaction before purchase controls that specific issue.
- The Returns and Refunds Policy controls matters specifically involving voluntary returns, refund calculations, return condition, restocking fees, exchanges, and warranty-return procedures.
- The Shipping Policy controls matters specifically involving fulfillment, shipping, carrier service, delivery, and shipping-related claims.
- These Terms of Service control other matters relating to use of the website and the overall transaction.
Nothing in this order-of-precedence provision overrides rights that applicable law does not permit the parties to modify by contract.
SECTION 26 - CHANGES TO THESE TERMS
We may update these Terms of Service and incorporated policies as our business, products, technology, payment systems, laws, or operational requirements change.
The current version is available through OrthoTape.com.
Material changes posted after a completed purchase do not retroactively change the material terms governing that completed transaction unless required by applicable law or separately agreed to by the parties.
Future use of the website and future purchases may be governed by updated terms and policies made available before that use or transaction.
